Portugal's New 10-Year Citizenship Rule: What Foreign Buyers Need to Know in 2026

If you're buying property in Portugal with a European passport in mind, the rules changed in May 2026. Lei Organica n.o 1/2026 came into force on 19 May 2026, raising the residency requirement for most nationalities. Here is what it means in plain terms - and what it means for how you plan your purchase.

What Changed and When

The Portuguese Parliament approved Lei Organica n.o 1/2026 on 1 April 2026. The law came into force on 19 May 2026 (Artigo 8.o sets the commencement as the day after publication in the Diario da Republica, issue n.o 95/2026, Serie I).

Before this law, the residency requirement for citizenship was a uniform 5 years for every nationality. Now:

  • Non-EU, non-CPLP nationals (US, UK, Turkey, South Africa, Canada, Australia, and all others): 10 years of legal residence
  • EU Member State nationals and CPLP nationals (Brazil, Angola, Cape Verde, and other Portuguese-speaking countries): 7 years

This rule applies equally to American, British, Turkish, South African, Canadian, and Australian buyers. Anyone outside the EU and CPLP family now needs a full decade of legal residence before applying for citizenship.

Who Gets Grandfathered In - and Who Does Not

The transitional clause in Artigo 7.o(2) of the law is deliberately narrow. Only nationality applications that were already filed AND still pending on 19 May 2026 keep the old 5-year rule.

Holding a Golden Visa before that date does NOT grandfather you. An investor who had a valid Golden Visa but had not yet filed for citizenship by 19 May 2026 is on the new 10-year clock.

If you started a Golden Visa in 2022 and planned to apply for citizenship in 2027, your timeline extended significantly. The clock does not restart - but you now need 10 years from permit issuance, not 5.

The Clock Starts at Issuance, Not Application

Under the new law (Art. 6(1)(b) of Lei 37/81 as amended), the 10-year residency period is counted from the date your residence permit is issued - not from when you applied.

The 2024 amendment that counted application-waiting time toward residency was repealed by Art. 5.o of Lei Organica 1/2026. Given that AIMA (Portugal's immigration agency) is currently processing first residence permits in roughly 12-24 months from filing (based on a reported backlog of 55,000+ applications as of mid-2026), the gap between application date and issuance date is a material planning variable.

An investor who filed their residence permit application in mid-2024 and received it in late 2025 lost roughly 12-18 months of citizenship-clock progress under the rules as they understood them. Those months now do not count.

Permanent Residency: A Separate Target, A Separate Law

Permanent residency is governed by a different law: Art. 80.o of Lei n.o 23/2007 (the Foreigners Law). It requires 5 years as holder of a valid temporary residence permit. The 2026 citizenship reform did not touch this law.

For a non-EU buyer starting today, the practical milestones look like this:

What the Golden Visa Still Offers

The five active Golden Visa investment routes remain unchanged:

  • 250,000 EUR cultural donation (200,000 EUR in low-density areas)
  • 500,000 EUR CMVM-regulated investment fund (currently the most popular route)
  • 500,000 EUR active business investment + 5 permanent jobs (3-year maintenance required)
  • 500,000 EUR scientific research or R&D
  • No capital minimum for creating 10 permanent jobs (8 in low-density areas)

The real-estate route was eliminated in October 2023 and is not available.

The Golden Visa gives you a legal residence permit with a minimal stay requirement: 7 days in the first year, 14 days per 2-year renewal cycle. It starts your citizenship clock. The 2026 law made the citizenship path longer, but the permit and its travel benefits remain the same.

How This Changes the Strategy Conversation

Before May 2026, many buyers used the Golden Visa as a 5-year citizenship play. That framing is now outdated. The questions worth asking are:

  • Is the citizenship path still your primary goal, or is EU residency + rental income a sufficient outcome on its own?
  • If citizenship is still the goal, are you prepared for a 10-year minimum commitment from permit issuance?
  • Would accelerating physical residency in Portugal shorten the effective wait by building stronger documentary proof of integration?

For buyers where EU access, rental income, and a foothold in Portugal are the goals - the 2026 law changes very little. The permit, the travel rights, the minimum stay requirement, and the property market itself are unaffected.

The NIF and Bank Account: Start the Clock as Early as You Can

The citizenship clock does not begin until your residence permit is issued. But the earlier you file the application, the earlier you receive that issuance date.

The typical preparation sequence for non-EU buyers pursuing the Golden Visa fund route:

1. Get a Portuguese NIF (tax number) - can be done remotely through a tax representative

2. Open a Portuguese bank account (most banks require a branch visit; Millennium BCP and Banco CTT are among the most accessible for non-residents)

3. Transfer funds and complete the qualifying investment (for the fund route: choose a CMVM-regulated fund, confirm the minimum subscription amount and lock-up period)

4. File the Golden Visa application through AIMA's online portal

5. Wait for the permit issuance date - this is Day One of your 10-year clock

None of this is fast, which is exactly why starting early matters more than it did before.

Checking Where You Actually Stand

Use these four questions to assess your situation:

  • Did you already hold a Golden Visa before 19 May 2026? If you had not yet filed for citizenship, you are on 10 years from permit issuance.
  • Did you file a citizenship application before 19 May 2026 that was still pending on that date? You may keep the old 5-year rule - verify with an immigration lawyer.
  • Are you an EU or CPLP national? Your requirement is 7 years from permit issuance, up from the previous 5.
  • Are you starting fresh in 2026? Count on 10 years from the date your permit is issued.
